Georgia Court of Appeals Affirms Bloom Parham’s Summary Judgment Victory
Bloom Parham represents a commercial property owner against claims brought by a plaintiff shot by a third party in the client’s property’s parking lot. Surveillance video showed the plaintiff punched his assailant prior to being shot. The firm successfully argued to the trial court that the plaintiff’s voluntary decision to start an altercation barred his claims as a matter of law. The Georgia Court of Appeals affirmed the trial court’s grant of summary judgment, agreeing that the plaintiff had ample time to leave the scene and avoid the possibility of injury but instead punched the shooter in the face, and this act precipitated the shooting. The court further determined that the plaintiff had superior knowledge of the potential danger based on his decision to engage in a fight on the property.
