Bloom Parham Wins Dismissal of Vicarious Liability Claims against National Homebuilder

Bloom Parham represents a national homebuilder in the defense of vicarious liability and negligence claims brought by an individual injured in an automobile collision with a vehicle driven by an employee of one of the homebuilder’s subcontractors. Plaintiff sought to hold the homebuilder vicariously liable for the negligence of the driver employed by the subcontractor, claiming the homebuilder exercised control over the driver. Bloom Parham successfully argued at summary judgment that the driver and the subcontractor were not the homebuilder’s employees, barring plaintiff’s claims against the homebuilder as a matter of law.  The court therefore dismissed all claims against the homebuilder.
