Bloom Parham Wins Reversal of Adverse Summary Judgment Order at Georgia Court of Appeals

Bloom Parham represents a purchaser regarding a dispute over the purchase and sale of an apartment complex.  During the due diligence period, purchaser discovered several misrepresentations made by seller, its principal, and its agent regarding the apartment complex and brought claims for breach of contract, fraud, and negligent misrepresentation. On summary judgment, Habersham County Superior Court allowed purchaser’s fraud and negligent misrepresentation claims to proceed against seller but dismissed the tort claims against the individuals. On appeal, the Georgia Court of Appeals reversed and reinstated the tort claims against the individuals, setting up trial on purchaser’s fraud and negligent misrepresentation claims against all three seller defendants.
