Georgia Court of Appeals Affirms Bloom Parham’s Summary Judgment Win

Bloom Parham represents a commercial real estate developer regarding the purchase of a property from a city development authority.  Leading up to the closing date, the development authority refused to execute a deed without including impermissible use restrictions.  The Fulton County Superior Court awarded summary judgment in favor of the developer on its claim for breach of contract. The Court of Appeals recently affirmed the grant of summary judgment, and the trial court will now consider whether to award specific performance requiring the development authority to issue a limited warranty deed and close on the sale of the property without the use restrictions.
