Bloom Parham Wins Summary Judgment In Insurance Coverage Dispute

Bloom Parham represents a national homebuilder in a dispute with an insurer regarding coverage for the homebuilder regarding a negligent construction judgment issued against the homebuilder in a prior case.  Bloom Parham moved for summary judgment on behalf of the homebuilder, and the U.S. District Court for the Northern District of Georgia ruled that the insurer had a duty to defend and a duty to indemnify the homebuilder with regard to the underlying case.  The court awarded the firm’s client almost all of the judgment amount and all the client’s attorneys’ fees incurred in defending the underlying case.  The firm successfully argued for coverage for its client under the applicable insurance policy by distinguishing an unfavorable Georgia case which limited additional insured coverage for general contractors.
