Bloom Parham secures win in Fulton County, GA, Superior Court – Business Division with successful defense against Defendant’s anti-SLAPP Motion

Bloom Parham represented one of the members of an LLC formed to own a 2,718 acre parcel of land located in Santa Rosa County, Florida as Plaintiff in a lawsuit where our client brought breach of operating agreement claims against the LLC’s managing entity and its individual members.  Following the successful defense against Defendants’ anti-SLAPP motion at the Court of Appeals of Georgia, the trial court found that Defendants’ “attempt to strike the Complaint [pursuant to Georgia’s anti-SLAPP statute] was manifestly frivolous and so completely lacking in legal basis or merit that it could only have been intended to unnecessarily delay this litigation.”  Due to such conduct, the trial court awarded Plaintiff $135,000 in attorney’s fees.
