Bloom Parham Defeats Another Challenge to Atlanta Public Safety Training Center

Bloom Parham secured the dismissal of a case seeking to challenge DeKalb County’s issuance of a land development permit (“LDP”) for the Atlanta Public Safety Training Center.  The petitioner, a member of the DeKalb County Commission, argued that DeKalb County should not have issued the LDP because construction of the Training Center would allow excessive amounts of sediment to be discharged into Intrenchment Creek, interfering with the Creek’s capacity to support aquatic life.  Bloom Parham successfully argued that the petitioner lacked standing to challenge the issuance of the LDP under well-established Georgia zoning law.  Following the trial court’s dismissal of the case, the petitioner did not file an appeal, and the trial court’s decision is now final.
