An environmental group asked the federal court to enjoin the development and construction of the Atlanta Public Safety Training Center.  Plaintiff argued that the  development is violating the federal Clean Water Act by causing excess sediment deposits into nearby Intrenchment Creek.  Following a hearing held in November 2023, Judge J.P. Boulee denied Plaintiff’s motion, holding that Plaintiff failed to show a substantial likelihood of success on the merits of its claim.  Judge Boulee found that the Atlanta Police Foundation and City of Atlanta put forth evidence that they have implemented and maintained best management practices for sediment and erosion control on the Training Center site as required by the applicable development permit.  Judge Boulee also found that the evidence showed that the site’s best management practices are working as designed and that development of the site is not contributing excess sediment to the creek.
