  • Obtained Summary Judgment in Manufacturer’s Favor in Products Liability Case
    Superior Court of California, County of San Francisco (2010) — Obtained summary judgment in favor of the manufacturer of a commercial lighting fixture that fell and allegedly injured an individual working in the office where that fixture had been installed. Despite the application of California law that is heavily slanted against product manufacturers and despite being in San Francisco Superior Court, one of the most plaintiff friendly jurisdictions in the United States, BSE attorneys were able to convince the court that, as a matter of law, the plaintiff had failed to demonstrate that any defective design played a part in the accident at issue. This significant victory avoided a trial where the plaintiff, a former Wall Street investment banker, planned to claim multiple millions of dollars in damages.
